Welcome to ChillTube Platform. This User Agreement (“Terms”) is generated by a computer system and does not require any physical or electronic signature.

1. INTRODUCTION

   These Terms govern your use of ChillTube services (“Services”). The Services include access to the content available on the ChillTube Platform, i.e. the website ("Website") and/or ChillTube Mobile Application (“Application”) (collectively, the "Platform").

   We encourage all Users to carefully read and understand these Terms before using the Platform and Services. Your access to and use of the Platform and Services is subject to these Terms and our Privacy Policy available at https://www.chilltube.in/privacy-policy.

   By visiting or accessing the Platform, registering and creating an account, using or availing the Services, or otherwise engaging with ChillTube, you acknowledge and accept these Terms and enter into a binding contract with Pheuture Studio Private Limited.

2. DEFINITIONS

   1. ‘Applicable Law’ means all applicable laws, rules, regulations, ordinances, guidelines, and by-laws of India, as well as any amendments thereto.
   2. ‘Platform’ means and includes the ChillTube Website, Application(s), and/or any other digital platforms through which ChillTube provides its Services.
   3. ‘User(s)’ / ‘You’ / ‘Your’ / ‘Yourself refers to an individual who has registered on the Platform and/or is availing the Services provided by ChillTube.
   4. ‘User Information’ means personal or financial information and other data provided by Users while using the Platform and Services.

3. ACCEPTANCE OF TERMS

   1. By accessing or using the Platform, you agree that you have read, understood, and accepted these Terms and agree to be bound by them.
   2. If you do not agree to these Terms, you must not access or use the Platform or Services.
   3. You affirm that you are at least 18 years of age and competent to enter into this Agreement.

4. USER ACCOUNT AND MEMBERSHIP

   1. To use certain features of the Platform, you may be required to register and create an account.
   2. You agree that all information provided by you is true, accurate, complete, and up to date.
   3. You are responsible for maintaining the confidentiality of your account and password.
   4. You agree to immediately notify us at apps@pheuture.com in case of unauthorized use of your account.
   5. ChillTube shall not be liable for any loss resulting from unauthorized access to your account.

5. SUBSCRIPTION SERVICES

   1. Access to premium content may require a paid subscription (“Subscription”). Subscription fees (“Subscription Fee”) and benefits may vary across different plans (“Subscription Plans”)
   2. ChillTube reserves the right to modify, terminate, or amend Subscription Plans at any time without notice.
   3. By subscribing, you authorize ChillTube to charge applicable Subscription Fees and taxes to your selected payment method.
   4. You confirm that the payment method used belongs to you or that you have authorization from the account holder.

6. USE OF THIRD-PARTY CONTENT OR LINKS

   1. The Platform may contain links or integrations with third-party content or applications. Your access and use of such third-party platforms are at your own risk
   2. ChillTube has no control over and assumes no responsibility for third-party websites, their content, or privacy policies.
   3. Users are advised to review the terms and privacy policies of any third-party platforms before use.
   4. You confirm that the payment method used belongs to you or that you have authorization from the account holder.

7. USER OBLIGATIONS AND RESTRICTIONS

   1. The Services are provided for personal and non-commercial use only.
   2. You agree not to engage in any of the following:
      • Reverse engineering, copying, or distributing any part of the Platform or Services without permission.
      • Violating intellectual property or privacy rights.
      • Introducing viruses, malicious code, or engaging in activities that disrupt the Platform.
   3. ChillTube reserves the right to suspend or terminate your account if you violate these Terms.

8. INTELLECTUAL PROPERTY RIGHTS

   1. All content, trademarks, designs, and other intellectual property on the Platform belong to Pheuture Studio Private Limited and/or its licensors.
   2. You may not copy, reproduce, distribute, transmit, display, sell, license, or exploit any part of the Platform for commercial purposes without prior written consent.

9. CHANGES TO THESE TERMS

   ChillTube reserves the right to modify, add, or remove portions of these Terms at any time without prior notice. Updates will be posted on https://www.chilltube.in, and continued use of the Platform after such changes constitutes acceptance of the revised Terms.

10. DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY

    1. The Platform and Services are provided “as is” and “as available” without warranties of any kind, express or implied.
    2. ChillTube does not guarantee that the Services will be uninterrupted or error-free.
    3. ChillTube is not responsible for any loss or damage resulting from your use of the Platform or third-party services linked to it.
    4. To the fullest extent permitted by law, ChillTube disclaims all liability for damages arising out of or in connection with your use of the Platform.

11. INDEMNIFICATION

    You agree to indemnify and hold harmless ChillTube, its affiliates, officers, directors, employees, and agents from and against any claims, damages, or expenses arising from your use of the Platform, breach of these Terms, or violation of any applicable laws.

12. SEVERABILITY

    If any provision of these Terms is found unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

13. GOVERNING LAW AND JURISDICTION

    These Terms shall be governed by and construed in accordance with the laws of India. The courts at Delhi, India shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms.
